Thank you for finding time to read our Terms of Service (herein the "Terms", "Terms of Service", "ToS", "Terms Agreement" ).

These Terms outline the rules and regulations for the use of InstaViral services and website located at https://instaviral.io/ Continued access to InstaViral website, ordering system, content, affiliate program, and/or any of its services indicates that you have read and agreed to the Terms stated in this document. 

The following Terms address InstaViral as "Us", "We", "Our", "Our Website", or "Service Provider", and you as "You", "Your", "User", "Website User", or "Customer".

1. INSTAVIRAL GENERAL USE 

These "General Use" cover how you access and use our website and services. The rules and guidelines apply to all users regardless of their gender, ethnicity, orientation, countries of origin, or place where they live.

1.1 Visiting and using our website or services offered at https://instaviral.io you are the subject to all modifications and changes to the following Terms of Service and our Privacy Promise.

1.2 We reserve the right to make additional changes to these Terms at any time without notifying customers and website users personally. It is your responsibility as a user and customer to keep track of the changes we make, and respond accordingly. 

1.3 All changes to Terms Agreement are made to improve website accessibility, user experience, and the quality of our services, and are subject to all applicable laws.

1.4 Changes made to these Terms of Service may involve website’s design and navigation, the range of services, pricing, order processing and/or delivery, customer reviews, emails and newsletters, cancellation and refunds, etc.

1.5 You shall not copy, alter, or use any content published under the name of InstaViral at https://instaviral.io. Domain name, website content, written or otherwise, brand logotype, and design patterns are protected by copyright laws.

1.6 Any false, hateful, and accusing statements, brand misrepresentation, or illegal reproduction of content without written permission on our side or our explicit consent is subject to copyright infringement, and will be addressed in court and prosecuted under applicable laws.

1.7 To access InstaViral website and use its services you must be 13 years of age or older. Users younger than 13 years of age, you must have a parent or legal guardian’s permission before ordering services.

1.8 Unauthorised and illegal use of credit cards or PayPal by minors or third-parties will be declined and prosecuted under applicable laws. Read more under "Pricing and Payments".

1.9 The recent version of current Terms can be found at the bottom of our website. Once the Terms are updated, changes will be saved in the recent version.

2. THE SERVICES AND THEIR PROVISION

This section refers to all services on our website, and conditions under which they are provided to our new and regular and returning customers as well as any third parties, and affiliates. For more on partnership use read Affiliate Terms.

2.1 InstaViral is not affiliated with Instagram, and does not make illegal use of its brand elements for personal gain. Any elements are only used in the altered form to abide by the copyright law.

2.2 Our services are offered for personal and business accounts to help Instagram users promote accounts and posts. They cannot be used to cause intentional damage or harm to any Instagram user, including but not limited to influencers, public figures, government and non-profit organizations, local or international businesses, agencies, or public institutions. 

2.3 Under no circumstances shall our website users/customers knowingly exploit the system to gain advantage, exploit its speed or bug in a manner other than purchasing services for their Instagram accounts, or for other accounts with owner's specific permission. 

2.4 System abuse, or any illegal or damaging actions such as uploading explicit or harmful content to Instagram, harassing InstaViral support team, or trolling other social media users while continuing to use our website and services will result in ban of such users and denied access to our system. Previous orders will be cancelled and no payment refunded.

2.5 In the event of system abuse, failure, or insufficient supply we reserve the right to stop providing any service, discounts, or program at any time and without prior notice to our users. All received and not processed orders for terminated services will receive a full refund.

2.6 A user accessing our free Instagram services or tools understands that because the services are offered voluntarily and not for any gain, the provision is limited and can be terminated upon insufficient supply, system inadequacy, or technical issues on our end. He/she also agrees to all applicable terms under current user agreement. 

2.7  Using any of our services or a website a user understands that we are not liable for any damage or loss supposedly incurred after ordering a service or accessing our website. All services must be accepted as is, and are used at one’s own risk.

2.8 A customer purchasing any of our paid services agrees to these Terms, and certifies that a purchase is made by the PayPal or credit card owner him/herself, or with a special permission from the owner. If the user is underaged (13 or younger), a parent or a legal guardian could make a purchase on his/her behalf. Read more under "Payment and Billing".

2.9. Customers, affiliates, and partners abusing these Terms agreement and/or our website, platform, system, brand name, or copyrights with ill intent or personal gain are subject to prosecution under all applicable laws. 

2.10 Buying followers, likes, comments, or views we provide does not mean users can violate Instagram Terms of Use. Nor does it mean they can hold InstaViral responsible for any damage, or loss (if any), arising from their decisions/ actions. 

2.11  Upon receival of superficially large or complex orders involving suspicious activity, we reserve the right to withhold their processing until the order details are verified. In extreme cases where the risk is perceived, a customer will be refunded and the order cancelled. Read more under "Cancellation and Refunds".

2.12 Users/customers abiding by these Terms should not question our integrity nor their orders completion. As a reputable Instagram growth agency, InstaViral will notify a customer if unable to complete the order for incorrect order details, account privacy settings, etc.

2.13  A customer should understand that changing a username, removing a video for which you placed the order will stop the delivery process and prevent order completion. Making your account private will also delay and/or prevent the delivery of your order. 

2.14 In case of no response upon contacting the customer on order details or correspondence of similar importance, the payment charged for the order will be re-credited to the customer's InstaWallet (inside user account) within 1-3 business days.

2.15 The credited sum can be used towards the next order for the same Instagram post/profile or another one.

2.16 Uncomplicated orders are processed within 2-4 hours (no more than 24 hours) after the payment has been received, and the delivery starts right after.

2.17 The order statuses and history can be seen from "Orders" inside a user account.

2.18 Abiding privacy requirements, InstaViral automatically creates a personal account for every first-time customer. From the account dashboard, order status, order history and payment details can also be accessed by the account owner. Any data on our website at https://instaviral.io is SSL encrypted. Still, basic safety measures apply. We ask account users to change account's password upon its creation, and delete cookies and never save passwords when accessing InstaViral from a public computer. For more on how we protect customer privacy refer to our Privacy Policy.

2.19 During some Instagram updates, public holidays and events, natural disasters, mass protests, and in other unfortunate circumstances order processing and delivery may slow down significantly. If more than 72 hours have passed but the order is still Pending or In Progress with no growth in the number of followers, likes, or views, reach out to [email protected] or via the Live chat.

2.20 Under such conditions, we ask you to make sure the Instagram account is set to Public, and a post has not been deleted. Changing your username, removing a video for which you placed the order will stop the delivery process and prevent order completion. Making your account private will also delay and/or prevent the delivery of your order. 

2.21 If you have mistakenly placed an order for the wrong account or took down your video while your order was in progress, reach out to support as soon as possible. Yet because order completion is made impossible for the reasons from your end, partial refunds, wallet re-credits, or link replacements are at our sole discretion. 

2.22 It is important that you check your order details and account settings before confirming the order and making any payment transaction.

2.23 If your order has not been processed yet, and/or less than 6-12 hours have passed, you can ask to send views, likes, likes, or followers for another Instagram post/profile. 

2.24 Accessing the service, a customer understands that the delivery time for all the services listed on our website is only approximate and cannot be interpreted as the exact delivery time. We ask users to understand that delivery, while automated and faster than manual, is impacted by the number of orders in queue, technical updates and issues, and may occasionally take longer than standard time.

2.25 Because of the provision of intangible irrevocable goods, you agree that the order, once placed and accepted, cannot be revoked or cancelled if the Order ID is assigned (unless an acceptable reason is presented).

2.26 While the likes, views, comments, or followers come from real Instagram users, InstaViral does not guarantee they will continue to like, view, or comment on other videos since the incentive such users are given is one-time. In rare cases users may unfollow a certain account, or revoke a comment or like.

2.27 In the event of drops of 5% or more of the purchased amount within the last 30 days after the purchase was made, customers qualify for immediate refill. To request a refill, you should contact us at [email protected]

2.28 In all other cases the services where refill is available, refill requests are reviewed on a case-by-case basis, and can be satisfied for up to 180 days after the last purchase was made. A customer has to provide a screenshot supporting his/her claims when discussing refills with support representatives. For each refill request a ticket is created, and an agent assigned to follow through. 

2.29 If failed to substantiate his/her claims with supporting screenshots and/or order ID, a refill request decision will be made at our sole discretion. 

2.30 Approved refills are fulfilled as they arrive. The standard time for refill depends on the amount of likes, views, or followers that has to be refilled. Most refill requests are fulfilled within 48-72 hours after they have been approved. 

3. PAYMENT AND BILLING

3.1 All prices quoted on the website of the provider include, in each case, statutory VAT, unless otherwise stated. 

3.2  For accessibility reasons, all prices are displayed, calculated, and accepted in US dollars. 

3.3 Customers can make a payment with the currency of their country of residence, which will be converted into US dollars according to the acceptable rates of their banking system. 

3.4 For all applicable external or internal reasons, InstaViral reserves the right to make any changes to pricing without prior notice to its users. 

3.5 For accessibility reasons, auto-applied discounts are offered on all services in various amounts. The rate of discount does not depend on personal circumstances, country of residence, gender, religion, and other discriminatory factors. The percentage discounted on a specific order is in direct correlation with the amount ordered. 

3.6 All services can be paid electronically via credit/debit cards, PayPal, or cryptocurrency. All major cards and crypto coins are accepted. We suggest you contact [email protected] should any payment issues arise.

4. CANCELLATION AND REFUNDS

4.1  Purchasing with InstaViral you understand that you are buying intangible, irrevocable goods and do not expect any physical products to be shipped to you. 

4.2  A change of mind cannot be considered as a viable reason for cancellation, and refunds will not be issued if the order has already been processed and/or delivered.

4.3 However, if a customer is enduring a damaging, life threatening, or difficult circumstance and can provide sufficient proof (a screenshot, a supportive document, etc.), and thus, wants to cancel his order, we suggest he/she contacts us at https://instaviral.com as soon as possible.

4.4 Individual requests are considered on a case-by-case basis, and will be satisfied in most of the cases.

4.5 You agree that upon purchasing you clearly understand what services you are purchasing and for which post, and will not file a fraudulent dispute or request a refund on an illegal basis.

4.6 Upon a fraudulent attempt to file a dispute, abuse the system, or trick, mistreat, and troll our support representatives, we have the right, if necessary, to terminate your account, and/or permanently ban you.

4.7 Refunds issued for cancelled orders can be partial and full.

4.8 Orders can be cancelled and refunded up to the full amount only if not processed and when (i) the service has gone out of stock before the order is fulfilled; (ii) the delivery has not started within 72 hours after the order is placed; (iii) order cannot be fulfilled for technical reasons, complexity, invalid details,etc.; (iv) announced delays for longer than 72 hours on our end because of technical issues, algorithm updates, etc.; (v) human emergencies and misfortunes as death, or accidents, and shortage of funds in such circumstances; (vi) a card/PayPal owner reports unauthorized access.

4.9  In an unfortunate turn of events, such as accidents, illnesses, death of a family member, natural disasters, etc. customers could request a full refund from all orders with the “Pending” status, and partial refund for orders “In Progress”.

4.10 Partial refunds are issued upon customer request when (a) the order has started but cannot be completed for viable reasons on our end; (b) unauthorised access is detected for an order, which is “In Progress”; (c) the order “In Progress” is taking longer than 96 hours to complete and customer wants to re-use the payment for a new order. (d) customer wants to cancel the order for serious issues with the account and/or posts (account hacked, deleted, video removed, etc.). 

4.11 Partial refunds deduct the sum for a part of the products that have been delivered.

4.12 When a customer wants to re-use the sum paid for the order on another order, partial/full refunds will be credited to his/her account wallet at https://instaviral.io/my-wallet/ within 3-24 hours after approval.

4.13 In some instances, if the services have gone out of stock before the order is fulfilled and is taking more than 96 hours to complete, you can cancel the order and request a refund by notifying the agent via Live Chat, or emailing us at [email protected] If the delivery has already started, you will get a partial refund, otherwise the payment in full will be credited back to you upon refund approval.

4.14 A PayPal/card owner can report unauthorized access and ask for refund if (a) a card is stolen or lost; (b) children under 13 years of age have accessed PayPal or card without parental notice; (c) identity theft is detected by the PayPal/card owner; Note, such cases have to be substantiated with screenshots, or other 

possible records. The owner must contact [email protected] as soon as he/she notices any illegal activity.

4.15 Issued refunds are re-credited to the user’s account wallet, PayPal, or cards within 12 – 72 hours after approval is granted. 

4.16 When order processing or delivery is delayed for acceptable reasons an agreement between a customer and InstaViral can be reached if you agree to wait some more time for certain reward or in compassion to our deficiencies. 

5. USER RIGHTS AND RESTRICTIONS

5.1 A user has the right to leave a website or stop accessing the services and tools at https://instaviral.io at any time, and at his/her own discretion. 

5.2  All users have the right to sign up as InstaViral affiliates, and earn affiliate commissions under all applicable Terms. For more information on how and why to become an InstaViral affiliate visit https://instaviral.io/affiliate-program/ or read Affiliate Terms.

5.3 Customers have the right to decide what, when, and how much to order from InstaViral. If absolutely necessary, a customer can request a suggestion of a dedicated support manager.

5.4 Users have the right to access website content, and use any statistical or other data elsewhere online with the attribution of the original source at InstaViral. 

5.5 Customers can decide to cancel an order and ask for a refund in acceptable circumstances including but not limited to human emergencies and misfortunes such as death, or accidents, and shortage of funds, or unauthorized access to a credit card notifying us at https://instaviral.io/contact-us/

5.6  Using the service for any illegal purpose or in violation of any local, state, national, or international law is strictly prohibited, and will be persecuted under applicable laws;

5.7 Under any circumstances users should not violate, or encourage others to violate, any right of a third party, including by infringing or misrepresenting any third party intellectual property rights;

5.8 Users agree not to interfere into security-related aspects of InstaViral services, including but not limited to: (a) disabling or circumventing features that prevent or limit use or copying of any content; (b) reverse engineering or otherwise attempting to discover the source code of any portion of the service except to the extent that the activity is expressly permitted by applicable law; or (c) hacking, password “mining” or using any other illegitimate means of interference;

5.9 A website user cannot modify or duplicate any part of the Service for personal gain, or as part of third-party agreement for which a user is paid or incentivised, without attributing InstaViral. Such cases fall under DMCA and copyright violation and will be prosecuted in accordance with all applicable laws.

5.10 Accessing InstaViral website, accessing any of its free or paid services, a user agrees to keep the basic rules of online conduct avoiding any actions that intentionally abuse our website, on-site search system, order and payment infrastructure of InstaViral system or any systems and networks connected to it;

5.11 All users are strictly prohibited to interfere with the operation of the service or any user’s enjoyment of the service, including by: (a) uploading or otherwise disseminating any virus, adware, spyware, worm, or other malicious code; (b) making any unsolicited offer or advertisement to another user of the Service; (c) collecting personal information about another user or third party without consent; or (d) interfering with or disrupting any network, equipment, or server connected to or used to provide InstaViral services;

5.12 InstaViral will not tolerate any fraudulent activity including but not limited to impersonating any person or entity, claiming a false affiliation, abusing the system in any way, including but not limited to using PayPal, or card that does not belong to a user and without the owner’s consent, or falsifying your age or date of birth;

6. ELECTRONIC COMMUNICATIONS

Any applicable correspondence between a user/customer and InstaViral, including but not limited to email correspondence on both sides, press releases, guest posts, interviews, or any publicly communicated data, and the use of such will be addressed under "Electronic Communications".

6.1 All website users as customers, affiliates, and website visitors are considered potential channels of communication, and must be treated as such.

6.2 All incoming and outcoming correspondence is subject to InstaViral Privacy Policy, and cannot be publicly disclosed unless a specific permission is granted by both of the sides. 

6.3 All inbox messages are reviewed and answered, if applicable, by the support team managers within 2-5 business days. Urgent messages are given priority and must be immediately forwarded to departments and people in charge.

6.4 Users are strictly advised not to share private documents, card details, personal photos, or any identifiable information unless specifically requested by the government officials or people directly relevant to the emerged issue In such cases, a person handling a user's case must identify him/herself first, and all the correspondence must go through the official corporate email address for privacy reasons.

6.5 In the event of delayed response, a user is asked to use another communication channel whether on social media, website forms, or otherwise. 

6.6 As part of communication channel, you agree not to publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information; upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents. Violation of privacy and online safety terms must be prosecuted under applicable laws.

6.7 Illegal adverts, false and unlawful information with the intent to damage the reputation of InstaViral services, its affiliates, directors, partners, shareholders, customers, users, or other entities involved in the provision of any of InstaViral services are subject to applicable laws.

6.8 All customers agree to receive relevant email updates on incorrect order details, order status, responses to their queries, and any other urgent updates whenever absolutely necessary.

6.9 As a user/customer you understand your right to terminate newsletter subscription(if any) protected under US's CAN-SPAM legislation. 

6.10 You also understand that invalid and incorrect email addresses while ordering InstaViral services will prevent you from receiving any email updates, including urgent and those specifically requested by you.

6.11 In such miscommunication cases, you agree to not hold the InstaViral support team responsible for any delayed response and/or damage or loss incurred under your own negligence.

6.12 For any questions and queries on partnership opportunities, content collaboration, and/or affiliate program membership users can contact [email protected] and their message will be forwarded to the person/department responsible.

6.13 Users must understand that order inquiries with inadequate and incorrect information or vague and unclear messages may also delay the response and the issue resolution (if any).

6.14 Users/customers willing to express gratitude, suggest an improvement, or report a bug or issue can submit messages via one of the channels: emailing to [email protected], Live Chat, contact form, or review form on corresponding pages of our website. We would advise not to leave a post comment on Instagram( with the exception of Instagram Direct Message), or other social media channels since it is easy to lose sight of important messages there. 

7. DISCLAIMER

YOU UNDERSTAND AND AGREE THAT THE INFORMATION, SOFTWARE, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE INSTAVIRAL WEBSITE ARE PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND, AND MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS IN THE MATERIALS ON INSTAVIRAL WEBSITE OR OTHERWISE RELATING TO SUCH MATERIALS OR ANY WEBSITES LINKED TO INSTAVIRAL. YOU HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE INFORMATION, SOFTWARE, SERVICES, RELATED GRAPHICS, CUSTOMER REVIEWS ON INSTAVIRAL, ITS PARTNER WEBSITES, AND NOT-AFFILIATED THIRD PARTY WEBSITES.

8. LIMITATIONS OF LIABILITY

YOU AGREE THAT YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY PROBLEMS OR DISSATISFACTION WITH THE INSTAVIRAL SERVICES IS TO LEAVE INSTAVIRAL WEBSITE AND TO STOP USING ANY OF THE INSTAVIRAL SERVICES. YOU AGREE THAT INSTAVIRAL HAS NO OBLIGATION OR LIABILITY ARISING FROM OR RELATED TO THIRD PARTY WEBSITES OR THE CONTENT AND SERVICES THEREOF MADE AVAILABLE THROUGH OR IN CONNECTION WITH THE INSTAVIRAL SERVICE. 

IN NO EVENT WILL INSTAVIRAL, ITS OFFICES, SHAREHOLDERS, EMPLOYEES, AGENTS, DIRECTORS, OR AFFILIATES BE LIABLE FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES; (B) ANY LOSS OF USE, DATA, BUSINESS, OR PROFITS (WHETHER DIRECT OR INDIRECT), IN ALL CASES ARISING OUT OF THE USE OF OR INABILITY TO USE THE INSTAVIRAL SERVICES, OR THIRD PARTY  CONTENT.

9. INDEMNIFICATION

You agree to indemnify and hold InstaViral harmless from and against all damages, losses, and expenses of any kind (including reasonable attorney fees and costs) arising out of or related to: (a) your breach of the Terms of Service, Affiliate Terms, or Privacy Policy, (b) the order(s) you place, and any identifiable information of you or other Instagram user; (c) payment details and other sensitive  information provided while the transaction is carried out and afterwards, (d) any activity in which you engage on or through the InstaViral Service; and (e) your violation of any governing local, federal, national, or international law or the rights of a third party.
